By accessing or using this website (the “Site”) operated by Elevated Therapy, you (“User,” “you,” or “your”) agree to be bound by these Terms of Use (the “Terms”). If you do not agree to these Terms, you must discontinue use of the Site immediately.

The Site provides general information about mental‑health services, therapist bios, appointment scheduling, and related resources. The Site does not provide emergency mental‑health care, crisis intervention, or a substitute for professional medical or psychiatric treatment.
No Therapist‑Patient Relationship
Viewing or interacting with the Site does not create a therapist‑patient relationship between you and any clinician associated with Elevated Therapy. A formal therapeutic relationship is established only after a signed informed‑consent agreement, intake forms, and an initial consultation conducted via secure video in accordance with Maryland law and applicable professional standards.
Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Site. By using the Site, you represent and warrant that you meet this eligibility requirement.
Privacy & Confidentiality
HIPAA Compliance: Any protected health information (PHI) transmitted through our secure client portal is governed by our separate Privacy Policy and the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

The total aggregate liability of Elevated Therapy for any claim arising under these Terms shall not exceed the amount you paid, if any, for access to the Site during the twelve (12) months preceding the claim.
Indemnification
You agree to defend, indemnify, and hold harmless Elevated Therapy, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of:

Termination
Elevated Therapy may suspend or terminate your access to the Site, without notice, for any reason, including but not limited to violation of these Terms or suspected fraudulent activity. Upon termination, all licenses granted herein cease, and you must promptly destroy any downloaded or printed copies of the Site’s content.
Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict‑of‑law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Howard County, Maryland, and you hereby consent to the personal jurisdiction of such courts.
Dispute Resolution
Informal Resolution: If a dispute arises, you agree to first contact Elevated Therapy at info@elevatedtherapy.co to attempt an informal resolution.
Arbitration (Optional): If the dispute cannot be resolved informally within thirty (30) days, the parties may elect to resolve the matter by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitrator’s award shall be final and enforceable in any court of competent jurisdiction.
Note: This arbitration clause may be waived by mutual written agreement of the parties.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Elevated Therapy regarding your use of the Site and supersede all prior or contemporaneous communications, whether oral or written.
